The Consolidated Appropriations Act of 2021 replenished the pool of EIDL money by $20Billion and the application deadline for the Small Business Administration’s (SBA) Economic Injury Disaster Loan (EIDL) program has been extended to December 31, 2021. This extension, unofficially referred to as the EIDL Round 2, is welcome news for many business owners suffering as the result of the ongoing pandemic.
The extension is part of the second Covid-19 Relief Bill signed into law on December 27th, 2020. While this part of the relief bill extends most of the provisions in the first EIDL program, little attention has been paid to it by the press. For this reason, we feel it is worthy to highlight its key provisions and the rules for the new targeted EIDL Advance, which is a grant.
EIDL Loan Program Key Provisions
- Eligible Borrowers include small business owners and agricultural businesses with 300 or less employees, non-profits in the US states, Washington D.C. and territories who have suffered a temporary loss of revenue due to the pandemic.
- Use of Proceeds include working capital, operating expenses such as payroll, healthcare insurance premiums, rent, utilities, existing fixed debt payments, including federal business debt payments as well as the prepayments of commercial debt.
- 30 Payment Term at 3.75% Fixed Rate for businesses and 2.75% Fixed Rate for nonprofits, with no pre-payment penalty.
- Up to $2,000,000 may be borrowed, effective September 8, 2021. If a borrower was previously subject to the former lower loan limits of $150,000 and $500,000, they may apply for an increase based on the new 24 month computation for qualification. To apply, login to your SBA EIDL portal and look for the button that says Request an Increase. If the button is not found on your portal main page, you will need to send the SBA an email to

with the “EIDL Increase Request for (insert your)10-digit application number” in the subject line. Include in the body of your email the following information:- Loan Application Number
- Loan Number (not the same as your loan application number!)
- Full Business Name
- Business Address
- Business Owner(s) names
- Phone Number
- No Collateral Requirement if EIDL is less than $25,000; If more than $25,000 the SBA files a General Security Agreement (UCC-1) form to collateralize the business’ assets. If EIDL is $200,000 or more, business owner collateral is required.
- Deferred payments will be granted for loans made in 2020 as well as 2021 for 24 months from the date of the note. During this deferred payment period interest on the note will accrue.
- For those businesses that received Emergency EIDL Advance (or Grants), the grant may be excluded from gross income on its tax return and is no longer required to be repaid if the business also received a PPP Loan which is fully forgiven. Prior to the Consolidated Appropriations Act of 2021, if a PPP Loan was forgiven and the business also received an EIDL grant, the EIDL grant would be converted to a loan under the PPPL terms.
New Targeted EIDL Advance Grants
When the original EIDL program launched in mid-2020, it included for applicants an Advance Grant amount of up to $10,000. To qualify for the first grant, a business would apply for the EIDL via the SBA’s website and within a matter of a few days would receive a deposit in its business bank account equal to $1,000 multiplied by the number of full-time employees (up to $10,000). By mid July, 2020, the SBA stopped making these grants because it ran out of money earmarked for the grant program.
The Consolidated Appropriations Act 2021 provides for an additional $20 Billion in grants to be distributed through the new targeted EIDL Advance program.
This time, an applicant must qualify for the EIDL advance as follows:
- There must be an economic loss of more than 30% measured by comparing any eight-week period between March 2, 2020 and December 31, 2020 to the comparable eight-week period during 2019; and
- The business must be located in a low-income community; and
- The business may not employ more than 300 employees; and
- The business must apply to the SBA by December 31, 2021. * AS OF MAY 28, 2021, THE SBA ANNOUNCED THE EIDL GRANT PROGRAM IS OUT OF MONEY. IN THE FINAL WEEK OF JUNE 2021, THE SBA OPENED THE EIDL GRANT PROGRAM AGAIN. SEE BELOW FOR UPDATED INSTRUCTIONS TO APPLY:
If an eligible business (see above) previously applied for the EIDL, they no longer need to wait for an email to be considered for the Targeted Advance grant. Instead, the applicant should call the SBA’s Disaster Customer Service Center at 800 659-2955 or email

If an eligible business did not apply for the EIDL program and would like to apply for the Targeted (or Supplemental) Advance grant, the should apply on the SBA Disaster Loan Assistance Application portal here.
Similar to the first round, it is not necessary for the business to accept the EIDL if it’s ultimately offered by the SBA. The business may keep the EIDL grant money received.
The Targeted EIDL Advance is being made available to two groups of applicants. The first group are those businesses and non-profits that received less than $10,000 the first time and the second group are those businesses and non-profits that did not receive any EIDL Advance due to the funds being exhausted.
If the business currently meets the eligibility criteria above, the SBA will send an email invitation directly to the applicants who did not receive the full $10,000 EIDL Advance or received no advance due to lack of funding in the summer of 2020. Upon receipt of the email from the SBA, the applicant may apply for the Targeted EIDL Advance.
It appears the SBA has lifted the former requirement that the applicant will be eligible to apply for the new, Targeted EIDL Advance only if they had applied for the EIDL program on or before December 27, 2020.
How to Apply for the EIDL Loan Program (not the EIDL Advance Grant)
As of July 1, 2021, the SBA has opened up EIDL Program applications again which means first-time applicants may apply on the SBA’s website here.
Below are a few tips based on our clients’ experiences when applying for the EIDL program:
In our practice, we’ve been involved with a number of clients who applied for the EIDL round one. A few of them did so in haste and spent the better part of the last six or so months trying to resolve their sloppy application. The SBA will reject an EIDL application if anything on the application doesn’t line up properly.
When you apply for the EIDL program, be certain the name of the business and its business address matches exactly what’s on your federal tax return and your business bank account. And verify the EIN used in the application matches the EIN on your business tax return.
Applicants often make the mistake of guestimating their 2019 gross revenue and cost of goods sold. Do not make this mistake. Look very carefully at your 2019 federal tax returns and find the figures in the Gross Revenue and Cost of Goods Sold boxes. Again, if you don’t get this right, your application will likely be rejected by the SBA.
The Gross Revenue and Cost of Goods Sold figures will drive the amount of EIDL because it determines the amount of working capital you need to operate your business. The EIDL loan is based on your business’ required working capital so it’s very important to get it right.
You should also be prepared to deliver the IRS Form 4506-T for your business. This form allows the IRS to pull your federal tax forms for your business for them to review. Technically, it’s the tax transcripts they will review. They will be looking at whether you’ve filed your and paid your federal taxes.
And if you get past these couple of hurdles, the SBA will also pull the personal credit scores from the credit bureaus for any shareholder (or other owner) holding 20% or more ownership stake in the business. If your credit score is low, it’s unlikely you will be approved for the EIDL loan.
You will also have to prove your identity with a valid photo ID and provide the SBA with a cancelled check for the business. They will verify the bank you’ve identified to receive your EIDL grant and/or loan proceeds is a legitimate business bank account. There was a lot of fraud in the EIDL first round so the SBA is being extra cautious — which is a good thing.
I received the $1000 first deposit and I was invited to apply, I believe in February, for the other portion. I was approved for the $9,000 and my status was funded. They tried to send it to an old bank account that I was forced to close. I have sent a voided check and drivers license photos to too many emails. Last week I was asked to submit my 2019 tax return, 4506-t, and a Schedule of Liabilities. If i just had a bank return issue, why would they want all of this, now?

Based on what they are asking for, it appears you are in the underwriting process where the SBA verifies everything.
The SBA has been under a lot of pressure to prevent fraudsters. You are not, they need to be sure of it!

DENIED again. How do you fix this? Does anyone have an accountant or service provider to apply for this? I need help obviously 🙁 This is after recon .. so don’t know what im doing wrong.
As previously stated in our correspondence dated April 22, 2021, your request was declined for over-stated revenues. There is a substantial discrepancy between the revenues verified with your 2019 IRS tax transcript and the pre-pandemic revenues you certified on your application. We cannot overcome the reason for decline without additional information.
Justin: Without seeing the details of your financials, it is not possible to figure out what you are doing incorrectly, but very often, non-accountants don’t understand the terminology. Revenue = Top line income before expenses. Your tax return needs to show the same figures, and depending on which tax form you are using, it may be different line numbers.
Much too often, business owners have a “habit” of under-reporting income to the IRS and then over-stating income to lenders (or in this case, the SBA). You may have done one or both of these things (accidentally, we’ll assume!). So in order to be fair, the SBA checks BOTH sides—your side and the IRS side to see if they match. The language here indicates that they don’t! So, which one will you need to fix?
Thanks so much for your response. It was for sure a clerical error and something I’d like to rectify . I put in a request to see the original loan application for the EIDL loan i received last year. This new one is the “eidl increase request”.. Question is if I was approved on the exact same tax transcripts for the first loan and declined on the second. Any help would be helpful .. is there a service that can help me with this mess? I really need this loan and have already been pushed around for 3 months by the sba’s tacky response.
Justin: You are assuming that there wasn’t a “clerical” error on the initial EIDL application. Those first apps weren’t given the same scrutiny as the bigger loans are. Second, you don’t want to get in a place where you are spending money with no guarantee of success–since the EIDL enhancements were first announced in April, public evidence is that fewer than 20% of the new applications have been approved so far. SBA is taking more time to reduce fraud through verification and better lending practices. Or, the well may be drying up.
I submitted my application for the targeted grant at the end of February 2021 and have yet to hear anything. I have tried calling and emailing and I get the same response each time. Your information has been submitted but we are waiting on all requested documents. I filled out the form T 4065 to get copies of my taxes so what else can they be waiting on? Or there still funds available?
Alonzo: Personal experience indicates the SBA is processing these things in 2-4 weeks. Find the phone number (sorry, I don’t have one handy) and give them a call. You’ll need your application number and/or EIN.
When will they start releasing funds for the EDIL Modifications. I don’t know that they released funds to anyone in the last three months. We just keep seeing in progress on our portal with everything completed. And apparently it’s affecting millions of people.

Does anyone else have an EIDL modification application status update for John?
I haven’t heard of anyone (or anyone that knows of anyone) actually getting their loan modification funded. Has anyone on this forum, or anyone they know actually received funds, i.e. deposited into their bank account? If so, how many out of the applications submitted? And there is no feedback from the SBA on timelines, just the same standard canned response that it’s being worked on. I’ve contacted my political representatives as well – maybe everyone should do the same.

The Increase request and app was sent in and after sending all the tax release forms nothing has happened
I have called sba so many times i lost count . I also send in a update request and no reply . One SBA agent told me she could not find my app , then she said ohhh they were waiting for IRS tax transcripts . I filed taxes the first of jan 21 . I am very frustrated with this whole process and bad info and no info .
Any ideas how to speak direct to the department and
bypass these people who know nothing except how to say be patient uffff . I even wrote my senator and she did not reply .

This was my experience & timeline on PPP, EIDL Increase Modification, EIDL Targeted Advance, & EIDL Supplemental Advance…
*I was eligible and approved for each program except… PPP Draw 2. I had almost gave up. I really thought that all funds would be exhausted before seeing anything approved, from 02/23/21 thru 08/03/21.*
–> 2/23: Invitation Targeted EIDL Advance
–> 3/3 or 3/5: Completed & Submitted Targeted Advance Application, as well as PPP Draw #1 Application
–> Maybe 1 hour later: SBA Trans # Assigned for PPP
–> About 3/28: SBA Portal updated to show EIDL Advance “Denied” (I was worried didn’t that was for the Original Advance, in 2020. Weeks later I still hadn’t received a transcript request meanwhile most received that email very quickly however I decided I’d quietly hurry up & wait because my 2019 return was “Still being Processed”.)
–> Around 4/6: Invitation for EIDL Increase Modification
–> 4/24: SBA Portal Update for selection of EIDL increase amount & E-sign for 2018 & 2019 transcript. I thought maybe the modification request will push/trigger my Targeted Advance App to take the next step.
–> 4/27: (Hope is starting to fade on getting anything that’s not repayable). I Finally got my PPP lender to respond & act on behalf of my PPP App- there was a small issue on the lender side with sending the E-sign request for the Loan Docs. PPP Draw 1 finally updated to the funding phase.

–> 6/16: FINALLY received Targeted Advance portal update email for 2019 transcript E-Sign request. PLUS IRS finally completed processing my 2019 Return.
–> 6/23: Invitation for Supplemental Advance App
–> 6/24: Targeted Advance Approved & Deposit Received
–> 6/29: 2019 Transcript E-sign request for Supplemental Advance App
–> 7/7: Supplemental Advance Approved & Deposit Received
–> 7/10: Increase Modification Approved. Waiting for me to accept & sign.

–> 7/25: Email reminder #3 (From SBA Attorney General- checking to make sure possible system issues are not preventing me from signing the loan documents or possible document changes/adjusts needed within the final loan documents; possible “typing” errors issues.)

The SBA is processing the EIDL Round 2 applications now so distribution of the loan proceeds occur as the business owner’s application is approved.
It’s not an automatic approval by the SBA. Instead, the loan application must go through the SBA for underwriting.

Unfortunately, the Targeted EIDL Advance program, which is a grant, is not available any longer.
Its funding dried up a while ago.
There is more money now for EIDL targeted advances. Do I need to change my 2nd business to a separate EIN ?

I stand corrected! I was able to verify with my sources and indeed the EIDL Grant money is flowing again!

As for your second business, the SBA makes the loans and issues the grants based on the social security number or EIN associated with the business. Whether they would deny your second business an EIDL Grant because another business you owned received a grant is unknown to me.
Regardless of the type of business applying, the SBA pulls the credit score of the business owners with more than 20% ownership for EIDL Loan applicants during their due diligence process before approving an EIDL loan. They do not do that for the EIDL Grant applicants.

Sounds like I have a similar story my applications we’re completed on my SBA portal status says “amount confirmed” but there is also a note that says “your loan modification is being processed”. Not sure what that means? Also what’s the best way to confirm if you are in fact in a low income area as defined by the SBA?

It appears you’ve applied for additional EIDL loan proceeds since the SBA is referring to it as a ‘loan modification’.
That’s a separate animal.
The EIDL Loan modification does not require you to be in the Low Income area. That requirement was related to the Emergency EIDL Advance (or Grant) program.
According to the SBA, they are still processing EIDL loan modifications and reconsiderations.
To pursue the EIDL grants, here’s the best resource we know of at this time.

Although it was possible to apply for the SBA’s PPP Loan program if in your situation, I do not believe it is possible for the EIDL program.
The business that’s applying has to identify the gross income and cost of goods sold in 2019 and those figures are used as the basis for computing how much the business is eligible to borrow under the EIDL program.
In your case, both figures would be zero.
If I learn anything different, that would apply to your situation, I will update my reply to your question.
