The Consolidated Appropriations Act of 2021 replenished the pool of EIDL money by $20Billion and the application deadline for the Small Business Administration’s (SBA) Economic Injury Disaster Loan (EIDL) program has been extended to December 31, 2021. This extension, unofficially referred to as the EIDL Round 2, is welcome news for many business owners suffering as the result of the ongoing pandemic.
The extension is part of the second Covid-19 Relief Bill signed into law on December 27th, 2020. While this part of the relief bill extends most of the provisions in the first EIDL program, little attention has been paid to it by the press. For this reason, we feel it is worthy to highlight its key provisions and the rules for the new targeted EIDL Advance, which is a grant.
EIDL Loan Program Key Provisions
- Eligible Borrowers include small business owners and agricultural businesses with 300 or less employees, non-profits in the US states, Washington D.C. and territories who have suffered a temporary loss of revenue due to the pandemic.
- Use of Proceeds include working capital, operating expenses such as payroll, healthcare insurance premiums, rent, utilities, existing fixed debt payments, including federal business debt payments as well as the prepayments of commercial debt.
- 30 Payment Term at 3.75% Fixed Rate for businesses and 2.75% Fixed Rate for nonprofits, with no pre-payment penalty.
- Up to $2,000,000 may be borrowed, effective September 8, 2021. If a borrower was previously subject to the former lower loan limits of $150,000 and $500,000, they may apply for an increase based on the new 24 month computation for qualification. To apply, login to your SBA EIDL portal and look for the button that says Request an Increase. If the button is not found on your portal main page, you will need to send the SBA an email to

with the “EIDL Increase Request for (insert your)10-digit application number” in the subject line. Include in the body of your email the following information:- Loan Application Number
- Loan Number (not the same as your loan application number!)
- Full Business Name
- Business Address
- Business Owner(s) names
- Phone Number
- No Collateral Requirement if EIDL is less than $25,000; If more than $25,000 the SBA files a General Security Agreement (UCC-1) form to collateralize the business’ assets. If EIDL is $200,000 or more, business owner collateral is required.
- Deferred payments will be granted for loans made in 2020 as well as 2021 for 24 months from the date of the note. During this deferred payment period interest on the note will accrue.
- For those businesses that received Emergency EIDL Advance (or Grants), the grant may be excluded from gross income on its tax return and is no longer required to be repaid if the business also received a PPP Loan which is fully forgiven. Prior to the Consolidated Appropriations Act of 2021, if a PPP Loan was forgiven and the business also received an EIDL grant, the EIDL grant would be converted to a loan under the PPPL terms.
New Targeted EIDL Advance Grants
When the original EIDL program launched in mid-2020, it included for applicants an Advance Grant amount of up to $10,000. To qualify for the first grant, a business would apply for the EIDL via the SBA’s website and within a matter of a few days would receive a deposit in its business bank account equal to $1,000 multiplied by the number of full-time employees (up to $10,000). By mid July, 2020, the SBA stopped making these grants because it ran out of money earmarked for the grant program.
The Consolidated Appropriations Act 2021 provides for an additional $20 Billion in grants to be distributed through the new targeted EIDL Advance program.
This time, an applicant must qualify for the EIDL advance as follows:
- There must be an economic loss of more than 30% measured by comparing any eight-week period between March 2, 2020 and December 31, 2020 to the comparable eight-week period during 2019; and
- The business must be located in a low-income community; and
- The business may not employ more than 300 employees; and
- The business must apply to the SBA by December 31, 2021. * AS OF MAY 28, 2021, THE SBA ANNOUNCED THE EIDL GRANT PROGRAM IS OUT OF MONEY. IN THE FINAL WEEK OF JUNE 2021, THE SBA OPENED THE EIDL GRANT PROGRAM AGAIN. SEE BELOW FOR UPDATED INSTRUCTIONS TO APPLY:
If an eligible business (see above) previously applied for the EIDL, they no longer need to wait for an email to be considered for the Targeted Advance grant. Instead, the applicant should call the SBA’s Disaster Customer Service Center at 800 659-2955 or email

If an eligible business did not apply for the EIDL program and would like to apply for the Targeted (or Supplemental) Advance grant, the should apply on the SBA Disaster Loan Assistance Application portal here.
Similar to the first round, it is not necessary for the business to accept the EIDL if it’s ultimately offered by the SBA. The business may keep the EIDL grant money received.
The Targeted EIDL Advance is being made available to two groups of applicants. The first group are those businesses and non-profits that received less than $10,000 the first time and the second group are those businesses and non-profits that did not receive any EIDL Advance due to the funds being exhausted.
If the business currently meets the eligibility criteria above, the SBA will send an email invitation directly to the applicants who did not receive the full $10,000 EIDL Advance or received no advance due to lack of funding in the summer of 2020. Upon receipt of the email from the SBA, the applicant may apply for the Targeted EIDL Advance.
It appears the SBA has lifted the former requirement that the applicant will be eligible to apply for the new, Targeted EIDL Advance only if they had applied for the EIDL program on or before December 27, 2020.
How to Apply for the EIDL Loan Program (not the EIDL Advance Grant)
As of July 1, 2021, the SBA has opened up EIDL Program applications again which means first-time applicants may apply on the SBA’s website here.
Below are a few tips based on our clients’ experiences when applying for the EIDL program:
In our practice, we’ve been involved with a number of clients who applied for the EIDL round one. A few of them did so in haste and spent the better part of the last six or so months trying to resolve their sloppy application. The SBA will reject an EIDL application if anything on the application doesn’t line up properly.
When you apply for the EIDL program, be certain the name of the business and its business address matches exactly what’s on your federal tax return and your business bank account. And verify the EIN used in the application matches the EIN on your business tax return.
Applicants often make the mistake of guestimating their 2019 gross revenue and cost of goods sold. Do not make this mistake. Look very carefully at your 2019 federal tax returns and find the figures in the Gross Revenue and Cost of Goods Sold boxes. Again, if you don’t get this right, your application will likely be rejected by the SBA.
The Gross Revenue and Cost of Goods Sold figures will drive the amount of EIDL because it determines the amount of working capital you need to operate your business. The EIDL loan is based on your business’ required working capital so it’s very important to get it right.
You should also be prepared to deliver the IRS Form 4506-T for your business. This form allows the IRS to pull your federal tax forms for your business for them to review. Technically, it’s the tax transcripts they will review. They will be looking at whether you’ve filed your and paid your federal taxes.
And if you get past these couple of hurdles, the SBA will also pull the personal credit scores from the credit bureaus for any shareholder (or other owner) holding 20% or more ownership stake in the business. If your credit score is low, it’s unlikely you will be approved for the EIDL loan.
You will also have to prove your identity with a valid photo ID and provide the SBA with a cancelled check for the business. They will verify the bank you’ve identified to receive your EIDL grant and/or loan proceeds is a legitimate business bank account. There was a lot of fraud in the EIDL first round so the SBA is being extra cautious — which is a good thing.
I have two small companies in the same business type/model. i received 24,000 and 21,000 the first round last year. This year i received 35,000 more for the 24, and still waiting on the 2nd on the 21, since early march. And also the Recon for the 24 and 35 with all paperwork in and agents been telling me for a month now that its on a desk or last stage before i hear something of the loan agent? what is taking so long for both? Both companies are re-opening in the last 2 weeks and i have minimal funds to pay employees? how much longer, im barely hanging on? thank you for any info, hopefully both come asap!!

I attended an SBA briefing with several Senators and they’ve indicated the EIDL backlog — which it sounds like your EIDL Reconsideration application is stuck in — should be cleared by the end of August. According to them, the SBA has deployed additional staff to address this huge problem.
My advice would be to stay on top of your inbox and reply to any requests quickly so you stay on top of the pile!

When the SBA considers your EIDL application, they do look at the owners’ (any one owning more than 20% of the business) personal credit score and that is because this SBA program is a loan that must be paid back. The EIDL program requires a minimum credit score for business owners to be at least 570.

It seems unfair that only people in low income areas can apply and qualify for a 2nd EIDL loan? Why is that? Why does my zip code have anything to do with my business!? I am a self employed licensed insurance agent- main base is Medicare. I was only in my 2nd of the business when the pandemic hit! I go to clients homes for appts and that basically stopped cold and now that the delta strain is active I’m afraid people (my clients are mostly elderly) they are not going to be comfortable with in home appts/visits for a long time.. so again, what does my zip code have to do with my business suffering? The low-income location requirement only applies to the EIDL Grant.
There is no location requirement whatsoever for the EIDL LOAN applicants.
You should be able to apply for the EIDL LOAN on the SBA’s website here.

I don’t believe the ceased billing for the first EIDL loan has anything at all to do with your second EIDL application status whatsoever.
To learn if your business is approved for the second EIDL loan, you should log into your SBA EIDL loan application portal or contact your SBA representative, if you have one.

I received a decline letter in my email from the SBA. It says unverifiable information, but all my information was correct. What does this mean?

I am sorry for your situation.
I am not certain what went wrong, however it’s likely something on your application for the EIDL did not match up with your IRS transcripts. If the figures don’t match, this type of EIDL decline letter is sent to the business owner.
You should request your transcript from the IRS, just like the SBA did, and compare your application to the figures on the transcript. This may give you a clue what’s not accurate and a place to start a RECONSIDERATION request.

Hello, and firstly, thank you for sharing your much appreciated wisdom, knowledge, and guidance! For my EIDL Targeted Advance application reconsideration (sole-proprietor), I have had no issues with any of my uploaded verification documents in my portal, but NOW, the final two documents, and the most simplest of all, have been marked as “incorrect!” These two things are a voided check, and my identification verification. For the first, since I don’t use/have printed physical checks for my account, I just used a free online site that allows you to create and print your own checks, after plugging-in your bank account information. I verified/downloaded a very professional looking check in PDF format ofcoarse, and uploaded to my portal. Why would they mark this as “incorrect?” My bank/acct. information is exactly as it appears on my bank statements, and since I don’t have a separate business name/EIN/TIN, I do use my personal checking account that’s in my name.
And as for the rejection of my photo ID, I’m assuming that since my driver’s license is expired, and displays an old, out-of-date address, that would result in an “incorrect” status, kind of a “no-brainer” there, right? It’s kinda funny, how I can successfully jump through all of the government’s various complex rings of fire, but when it comes down to the cut & dry simple things, I drop the ball!

For proof of checking account, your bank can print a letter that can be used for verification.
For ID, yeah, it has to be unexpired. There is a reason why IDs expire. It isn’t because the paper is getting moldy.

Question — during the 2019 filing year, my business wasn’t tracking inventory by cost of goods, but rather rolling that all into “supplies.” That was the number I provided for “cost of goods” on the app. Should I be concerned?

When the SBA verifies EIDL eligibility, they look at your federal tax return and look for the figure that appears in the Gross Profit box. That figure is computed by deducting the Cost of Goods Sold from the Gross Revenue. That figure (Gross Profit) in 2019 is the basis for computing how much your business is eligible to borrow in the EIDL program.
Unfortunately for many, the instructions for the EIDL program do not make that clear and many business owners made errors when applying.
You may want to consider amending your 2019 federal tax return and notifying the SBA. This will slow down an already slow process I am afraid. That said, it’s very unlikely the SBA will approve your EIDL loan if the figure in the Gross Profit box on your federal tax return does not agree with the gross profit margin you indicated on your federal tax return.

My question is when will the eidl open for those of us not in a low income area? It’s pretty rediculous that we are being left out as though because of our location it makes it easier to get help. Are we supposed to ask our supposed wealthy neighbors? Because many of us are closing down without help.
Not a conspiracy theorist, but I can’t wrap my head around the blatant disregard for helping ALL who are struggling, despite their geographic location.
Jen: We all understand the frustration any time the government favors one group over another. However, the actual EIDL program is open to ALL business owners that suffered financial hardship and is not limited to any socio-economic group. There have been a few sub-programs, such as the EIDL Advance, which ultimately gave away up to $5K to15K (TOTAL!) as a grant to those in more challenging geographic areas. But $15K giveaway is going to make a difference to only the smallest of small businesses. It’s a drop in the bucket even to a mom-n-pop restaurant. But that’s where the full EIDL loans are meant to help.
I used my entire life savings to open a one employee (me) salon, after going back to school in my late 30’s. I was finally able to make a profit late 2019 – early 2020. Then was of course, shut down via mandates from our governor.
Not to mention our economy in my area took double hit when the oil industry tanked.
10% of what is available to low income areas would be a substantial help to us s micro businesses. They haven’t even used a third of the money, they are begging people to apply instead of opening up to other businesses.
State wide, the only grants available are for those who are in accommodations. On top of the extra they get federally.
It may not be important to most, but I am systematically watching my lifetime dream fade away.

The EIDL Advances are outright grants — not intended to be paid back.
The EIDL Loans are low-interest, long-term loans to help businesses recapitalize their business so they may survive.
If you have at least one employee on the payroll, then you may be eligible for the Employee Retention Credit. This form of assistance is available for both 2020 and 2021 and is not a loan either.

I am very sorry for your situation.
If you have employees, you may be eligible for the ERC (an employee tax credit) if you’ve continued employing people in 2020 and/or 2021.
This credit is available now and is refundable to your business for the current quarter. It’s also available retroactively.
The rules around the Employee Retention Tax Credit keep changing (surprise!). The post I’ve linked out to has been updated this month to reflect the cumulative changes.
